Fenomenologie van het proces van bewijzen in strafzaken In deze bijdrage staat de activiteit van bewijzen in strafzaken centraal. Betoogd wordt dat de vigerende rationalistische opvatting van strafrechtelijk bewijzen eraan voorbij gaat dat het bewijzen zich allereerst voltrekt op een vóór-reflectief niveau. Het primaire blikveld van de mens is namelijk niet het objectiverende kennen, zoals in de rationele bewijstheorieën wordt voorondersteld, maar de praktische relatie tot de wereld. In dit kader wordt eerst de filosofische achtergrond van de rationalistische bewijsopvatting in (...) kaart gebracht, in het bijzonder de invloed van Aristoteles en Descartes. Vervolgens worden de daaruit voortkomende bevindingen aan de hand van ideeën en inzichten die zijn ontleend aan de existentiële fenomenologie kritisch gewaardeerd. This document presents the Bonn PRINTEGER Consensus Statement: Working with Research Integrity—Guidance for research performing organisations. The aim of the statement is to complement existing instruments by focusing specifically on institutional responsibilities for strengthening integrity. It takes into account the daily challenges and organisational contexts of most researchers. The statement intends to make research integrity challenges recognisable from the work-floor perspective, providing concrete advice on organisational measures to strengthen integrity. Der Gedanke, der sich in der modernen Idee der Autonomie verdichtet, ist ein doppelter: Die Figur der Autonomie enthält zugleich eine neue Auffassung von Normativität und eine eigene Konzeption von Freiheit. Dem Gedanken der Autonomie zufolge ist ein Gesetz, das wahrhaft normativ ist, eines, als dessen Urheber wir uns selbst betrachten können; und eine Freiheit, die im vollen Sinne wirklich ist, drückt sich in Gestalt eben solcher selbstgegebener Gesetze aus. Die Idee der Autonomie artikuliert so die Einsicht, dass man Freiheit (...) und Gesetz nicht durch ihre Entgegensetzung bestimmen kann, sondern durcheinander erläutern muss. Wirkliche Freiheit ist nicht Freiheit von Gesetzen, sondern Freiheit in Gesetzen; verbindliche Normen sind nicht das, was Freiheit äußerlich beschränkt, sondern das, was Freiheit innerlich verwirklicht. Die Idee der Autonomie, die für die moderne praktische Philosophie seit Rousseau und Kant grundlegend ist, zielt so darauf, Freiheit und Verbindlichkeit in einem Zuge zu artikulieren: durch die Form selbstgegebener Gesetze. Transdisciplinary research knits together knowledge from diverse epistemic communities in addressing social-environmental challenges, such as biodiversity loss, climate crises, food insecurity, and public health. This paper reflects on the roles of philosophy of science in transdisciplinary research while focusing on Indigenous and other subaltern forms of knowledge. We offer a critical assessment of demarcationist approaches in philosophy of science and outline a constructive alternative of transdisciplinary philosophy of science. While a demarcationist focus obscures the complex relations between epistemic communities, transdisciplinary (...) philosophy of science provides resources for meeting epistemic and political challenges of collaborative knowledge production. Thomas Kuhn's philosophy of science, which he developed by focusing on physics, was later applied by other authors to virtually all areas or disciplines of culture. What interests me here, however, is the movement in the opposite direction: the role that one of these disciplines, history of art, played in the conception of Kuhn'stheoryof science.In a 1969 article, his only published text concerning science and art, Kuhn makes a brief and intriguing observation about The Structure of Scientific Revolutions. This article examines Jacques Derrida’s work of self-reflection on his own teaching practice by using as a guiding thread the problematics of reproduction in the seminars of the 1970s. The first part of the article examines the sequence of seminars taught by Derrida at École normale supérieure from 1971 to 1977 to show how the concept of reproduction is deconstructed by Derrida across several seminars. Derrida systematically demonstrates, across several themes and fields (sociology and economy, biology and sexuality, art, technique, (...) ontology, and so on), that the critical recourse to the concept of reproduction (for instance, in its Marxist form) risks being complicit in the reproductive system it criticizes. The deconstructive motif of débordement is introduced to problematize this onto-logic of re-production. The second part of the article analyzes more specifically the unpublished seminar “GREPH, le concept de l’idéologie chez les idéologues français” (1974–75), in which Derrida examines the seminar function, his role as a teacher, and his own situation within the French educational system. In particular, Derrida offers a deconstructive critique of the reproductive effects of teaching, and of the institution of philosophy inasmuch as it functions as a reproductive machine. This work of deconstruction is done in the seminar notably through readings of Marx, Engels, and Althusser, with special attention to the concepts of ideology, reproduction, and sexual difference. From an evolutionary perspective, both atavism and somatic evolution/convergent evolution theories can account for the consistent occurrence, and astounding attributes of cancers: being able to evolve from a single cell to a complex organized system, and malignant transformations showing significant similarities across organs, individuals, and species. Here, we first provide an overview of these two hypotheses, including the possibility of them not being mutually exclusive, but rather potentially representing the two extremes of a continuum in which the diversity of cancers (...) can emerge. In reviewing the current literature, we also discuss the criteria that should be applied to discriminate between the two competing theories and to determine their relevant contributions to oncogenesis and cancer progression. Finally, we deliberate on the potential applications of this conceptual framework in developing novel treatment strategies. (shrink)

Trois hypothèses sont défendues : 1) Cette phénoménologie professe une forme de réalisme de l'expérience, qui est le véritable point de ralliement des différentes élaborations. 2) Ce type d'empirisme opère la dilution du discours philosophique dans une multitude de discours autres. 3) De ce strict point de vue, il n'est guère de différence entre la phénoménologie française et une certaine partie de la philosophie analytique française. This study will defend three hypotheses: 1) contemporary French phenomenology adopts a form of experiential realism, which is the true rallying point of otherwise differing elaborations; 2) this type of empiricism leads to the dilution of philosophical discourse into a multitude of other discourses; 3) If this is the case, then there is no real significant difference between French phenomenology and a certain part of French analytical philosophy. The earlier volume in this series dealt with two religions of Indian origin, namely, Buddhism and Jainism. The Indian religious scene, however, is characterized by not only religions which originated in India but also by religions which entered India from outside India and made their home here. Thus religious life in India has been enlivened throughout its history by the presence of religions of foreign origin on its soil almost from the very time they came into existence. This volume covers (...) three such religions—Zoraoastrianism, Judaism, and Islam. In the case of Zoraostianism, even its very beginnings are intertwined with India, as Zoroastrianism reformed a preexisting religion which had strong links to the Vedic heritage of India. This relationship took on a new dimension when a Zoroastrian community, fearing persecution in Persia after its Arab conquest, sought shelter in western India and ultimately went on to produce India’s pioneering nationalist in the figure of Dadabhai Naoroji ( 1825-1917), also known as the Grand Old Man of India. Jews found refuge in south India after the destruction of the Temple by the Romans in 70 C.E. and have remained a part of the Indian religious scene since then, some even returning to Israel after it was founded in 1948. Islam arrived in Kerala as soon as it was founded and one of the earliest mosques in the history of Islam is found in India. Islam differs from the previously mentioned religions inasmuch as it went on to gain political hegemony over parts of the country for considerable periods of time, which meant that its impact on the religious life of the subcontinent has been greater compared to the other religions. It has also meant that Islam has existed in a religiously plural environment in India for a longer period than elsewhere in the world so that not only has Islam left a mark on India, India has also left its mark on it. Indeed all the three religions covered in this volume share this dual feature, that they have profoundly influenced Indian religious life and have also in turn been profoundly influenced by their presence in India. Este ensayo presenta una descripción de los escritos inéditos de Jacques Derrida sobre Marx y Louis Althusser en la década de 1970, y un estudio de conceptos como ideología, diferencia sexual, reproducción, violencia, dominación o hegemonía en perspectiva deconstructiva. Se trata de pensar en una otra economía, más allá de la economía del cuerpo propio. El artículo fue publicado en el Volumen 7 de la Revista Demarcaciones, "a 25 años de Espectros de Marx.".

Numa sociedade democrática, as regras sociais são impostas a cada um por todos. Como “recebedores” de tais regras, tendemos a pensar que elas deviam ser designadas para engendrar a melhor distribuição possível de bens e males ou qualidade de vida. Enquanto autores das regras, tendemos a pensar que os malefícios por nós impostos através de tais regras têm maior peso moral que os danos que nós meramente deixamos de evitar ou mitigar. Embora as atuais teorias sejam dominadas pela primeira perspectiva, (...) uma concepção adequada da justiça exige um balanceamento de ambas tendências. O tema da equidade na saúde é bem apropriado para mostrar como concepções da justiça puramente dirigidas aos recebedores estão fadadas ao fracasso e como esboçar uma alternativa mais promissora. Al hilo de los movimientos filosóficos de la última década en Estados Unidos, el autor intenta defender la tesis de que la teoría social crítica y las historias genealógicas interpretadas tal como lo hacía Foucault al final de su vida, lejos de oponerse, pueden de alguna manera complementarse de forma fecunda. Para realizar esta tarea, el autor mostrará, en primer lugar, la amplitud de las afinidades entre ambos pensamientos A continuación, realizará una profunda crítica de la interpretación que Foucault daba (...) de su propio pensamiento en los años setenta, mostrando al tiempo que la genealogía es susceptible de una mejor caracterización mediante el esquema clásico de dominación crítica- emancipación. Plotin considère parfois l’intellection comme une sorte de sensation, alors qu’il distingue par ailleurs fortement les deux activités. Le but de cet article est d’étudier cette description qui semble paradoxale dans la mesure où l’intellection est ramenée à un processus auquel elle est opposée en même temps. Nous devons tout d’abord mettre en lumière le lien entre la sensation et l’intellection. Il est ensuite nécessaire de montrer de quelle manière la sensation est considérée comme un modèle qui rend compte du (...) processus de la pensée intuitive. C’est la vue qui apparaît comme le sens permettant de décrire l’intellection de la façon la plus adéquate. Mais la sensation ne constitue pas seulement un modèle et les réalités intelligibles sont appelées «les choses sensibles de là-bas», «ces corps» ou encore «les choses visibles». Nous cherchons, en un mot, à comprendre la signification de ces expressions qui semblent contraires à la doctrine platonicienne. (shrink)

The twelve essays in the volume, written by leading classical philosophers, investigate various aspects of these works of Plato, including the significance of Plato's characters, Socrates's revolutionary religious ideas, and the relationship between historical events and Plato's texts.

The 2013 Rostock Symposium on Systems Biology and Bioinformatics in Aging Research was again dedicated to dissecting the aging process using in silico means. A particular focus was on ontologies, as these are a key technology to systematically integrate heterogeneous information about the aging process. Related topics were databases and data integration. Other talks tackled modeling issues and applications, the latter including talks focussed on marker development and cellular stress as well as on diseases, in particular on diseases of kidney (...) and skin. Crises such as water quality, pollution, climate change, overfishing, biodiversity, energy, waste, and carbon sequestration mean that legislation protecting the marine environment is under intense pressure to be effective and to demonstrate positive results in a vast array of public and private spheres. Thus far, scholarship of EU marine environmental law has been focused primarily on (i) interaction with international agreements (ii) spatial/jurisdictional studies (iii) analysis of new laws, plans and programmes (iv) principles (e.g. good environmental status, precautionary approach, polluter (...) pays) (v) CJEU case analysis (vi) enforcement (vii) specific issues (plastics, litter…). However, over the years the mass constituted by the EU marine environment acquis has grown ever-larger, leading to risks of poor coordination, over-regulation in some areas and lack of regulation in others. By triangulating complementary investigatory methodologies, this study teases out systemic, diachronic and legilinguistic interlinkages—within and across key instruments as well as EU institutions, bodies and agencies. Our results provide avenues for policymakers nationally and at EU level to improve the legibility and coherence of marine environmental regulation—to the benefit of citizens and the wider body of stakeholders, and, ultimately, to benefit the marine world. It presents the voices of important representatives of humanities, cultural and natural sciences through programmatic texts from the mid-19th century to the mid-20th century. Geprägt von metaethischen Fragestellungen hat sich die philosophische Diskussion wieder intensiv mit der ontologischen und erkenntnistheoretischen Dimension von Werten befasst und der Phänomenologie zu einer Relecture verholfen. Zugleich hat die Tugendethik eine Renaissance erfahren. In die Schnittstellen dieser aktuellen moralphilosophischen Debatten arbeitet dieses Buch den originären Ansatz Edith Steins zu einer Ethik des christlichen Glaubens heraus. Auf der Grundlage des Personbegriffs entwickelt Edith Stein eine innovative Tugenderkenntnistheorie, deren Bezugspunkt die Wahrheitsfrage ist. Es geht ihr dabei um eine intersubjektiv, in personaler (...) Kommunikation vermittelte Erkenntnis des sittlich Guten, d. h. aber zugleich um eine unmittelbare Konnaturalität mit dem Guten. (shrink)

Les études sur la migration ont mis l’accent sur la dimension relationnelle du processus de migration, cependant le sujet a rarement été analysé systématiquement à l’aide de l’analyse des réseaux sociaux. À partir d’entretiens avec des jeunes et adultes espagnols installés à Toulouse entre 2004 et 2014, cet article montre la diversité des configurations de réseaux. Cette diversité est due à la variété des processus de mobilité et des parcours biographiques. Au fil des mois et après quelques années de résidence (...) à Toulouse, ces personnes ont subi une reconfiguration de leur entourage qui associe principalement des relations avec des personnes résidant dans le lieu d’origine et d’autres qui sont locales. Cette reconfiguration aura comme points forts la rupture avec certains liens dans la société d’origine mais aussi l’activation de nouvelles relations, ainsi que l’intensification de nouveaux et d’anciens liens à cause de la mobilité. Cette diversité est expliquée dans l’article en examinant les caractéristiques et les circonstances vécues avant la mobilité, ainsi que les caractéristiques de leurs contacts prémigratoires. Cet article est une explication suivie et presque complète du chapitre III, 12 des Entretiens d’Épictète intitulé « Sur l’exercice » et en particulier de l’opposition qu’il propose entre les exercices des acrobates et ceux du philosophe. On analyse la discussion sous-jacente avec Diogène de Sinope et la critique de la dimension spectaculaire des exercices cyniques, à laquelle Epictète oppose un entraînement philosophique essentiellement privé et même invisible.

Nos deteremos aqui sobre a crítica de Matthew Kramer em relação à interpretação de Quentin Skinner sobre o conceito de “liberdade” em Hobbes contida em seu artigo “On the Unavoidability of Actions: Quentin Skinner, Thomas Hobbes, and the Modern Doctrine of Negative Liberty” (2001). Nele, Kramer trata do então crescente interesse do projeto intelectual de Skinner pelo pensamento hobbesiano, algo já evidenciado desde a publicação de seu livro Liberdade Antes do Liberalismo (1998). Kramer toma como referência central de sua (...) resposta o artigo de Skinner intitulado “Thomas Hobbes on the Proper Signification of Liberty”, criticando a sua posição e contrastando com algumas de suas próprias ideias sobre “liberdade” e “não-liberdade”. Através dessas considerações, Kramer reavalia a noção da liberdade em Hobbes, tomando-a como o protótipo liberal da liberdade negativa por excelência, demonstrando assim os supostos equívocos contidos na interpretação de Skinner sobre ela. Buscamos defender aqui, contudo, que a proposta interpretativa de Kramer carece da devida fundamentação metodológica que correlaciona o neorrepublicanismo de Skinner no campo da filosofia política com certos princípios oriundos de sua historiografia que não são devidamente considerados pelo primeiro. A sua crítica estaria, assim, comprometida por uma abordagem desconectada do pensamento e das intenções de Hobbes enquanto um agente político inserido em um determinado contexto linguístico e social, quadro que seria posteriormente resgatado de maneira primorosa por Skinner em seu estudo Hobbes and Republican Liberty (2008). In this study, we attempt to show how the "art of persuasion" delivers a new conception of method, one that makes it possible to resolve the practical problems imposed by grounding truth in evidence alone. In this way, we show that the different determinations of the art of persuasion that run through the eponymous text, describe the various modalities of a single doctrine of persuasion that substitutes the precept of evidence – without denying it – for the need to define (...) and demonstrate principles.
